Article 1. Scope of application of the general conditions of sale

These general conditions of sale detail the rights and obligations between Filmobile S.A. and the Customer. Validation of the order by the Customer on the www.get-out-escape.ch website implies unreserved acceptance of these general conditions of sale, without this acceptance requiring a handwritten or electronic signature on the part of the Customer. . The applicable general conditions of sale are those in force on the day the order is placed.

The fact that Filmobile S.A. does not avail itself at a given time of any of the provisions of the general conditions of sale cannot be interpreted as a waiver of its right to avail itself subsequently. If one or more of the stipulations of the general conditions of sale is held, rendered or declared invalid due to a law, regulation or decision of a competent jurisdiction, all other provisions will continue to apply. apply, provided that the void or invalid provision was not a determining condition of the consent of the Company or the Client on the date of the conclusion of these presents.

Article 2. Reservation

Access to the Game takes place after reservation and full payment of the game on the website.

The Customer is responsible for entering their contact details on the online reservation form and guarantees the accuracy and veracity of the information provided.

The reservation is nominative and valid for a specific day and time slot.

In the event that the reservation for the game imposes an age limit, Filmobile S.A. reserves the right to request proof of identity on the day of the event.

Any reservation is made within the limit of available places and only becomes definitive upon receipt by the Customer of a confirmation email.

Additional services included in the birthday packages, such as cinema vouchers, are valid from the day after the event.

Article 3. Change – cancellation or postponement of the order

No reservation can be canceled or refunded.

If it is impossible for Filmobile S.A. to start the game (Force Majeure, network or electricity outage, flooding, etc.), the CUSTOMER will be offered a refund.

Article 4. Delay

If the customer is late, the duration of the game may be reduced so that it can end at the scheduled time. In this case, the CUSTOMER will not be able to claim a refund or a relocation of the game.

Article 5. Breakage, loss and damage

In the event of breakage, loss or damage through its own doing, the CUSTOMER agrees to assume total responsibility. An invoice will be sent to him by Filmobile S.A.

Article 4. Prices and payment terms

7.1 The price of a reservation is indicated on the WEBSITE in CHF including tax.

7.2 Any other service will result in additional invoicing.

7.3 The price is set according to the number of people within the same team.

7.4 Filmobile S.A. reserves the right to modify its prices at any time, the service being however invoiced at the rate in force at the time of payment of the reservation.

7.5 Only payment by credit card or Twint is accepted on the WEBSITE. If the RESERVER could not pay by credit card or Twint, a reservation by transfer can be requested by email to info@get-out-escape.ch on the condition of payment no later than 48 working hours before the game.

7.6 Filmobile S.A. has entrusted its payment system to a service provider specializing in securing online payments and does not store any data related to the payment system in its databases.

7.7 Full payment is required at time of booking.

7.8 In the event that fewer CUSTOMERS than at the time of reservation show up to participate in the part that is reserved, the difference will be returned in the form of a gift voucher.

7.9 If more people show up than the number of players who paid when booking, the price difference will have to be paid before participating in the game, within the limit of the number of players authorized.

7.10 Filmobile S.A. reserves the right to refuse any reservation to a RESERVER who has not paid all the services which would have been invoiced to him.

Article 5. Customer Obligations

The Client undertakes to comply with this Contract, as well as with all laws and regulations and other rules and instructions which may be imposed on him in writing and/or orally during the course of the Game.

Each Customer undertakes to read and respect the safety and fire protection instructions and evacuation measures. Emergency exits are clearly identified. It is strictly forbidden to block or obstruct emergency exits, which must remain clear in all circumstances. The Customer may use the emergency exit only in the event of a situation making evacuation necessary (fire for example). Any abuse, untimely opening of these exits by a Customer, will result in the costs generated by this abuse being re-invoiced to the Customer.

The Customer is also informed that he is prohibited from bringing objects considered to be physical dangers and dangerous to health, without limitation: sharp, flammable or prohibited objects.

Given the nature of the Game, the Customer is also prohibited from taking photos or recording videos during the Game.

Tout manquement pourrait entraîner l’exclusion immédiate du Client, et ce sans que cela ne donne lieu à un remboursement ou à une quelconque compensation ou indemnité.

As a security measure, Filmobile S.A. also reserves the right to refuse access to the Game to any Customer under the influence or influence of alcohol and/or drugs. This ban would not give rise to any reimbursement or any compensation or indemnity.

Article 6. Duration

The Customer accepts that the Game lasts for a fixed and maximum duration.

The Customer also accepts that the game may end before the indicated duration, in the event that he discovers all of the puzzles in the game, without this giving rise to a price adjustment.

Article 7. Responsibility

Filmobile S.A. can only be held responsible for its own faults which have been proven. In any event, compensation for damage suffered by the Customer due to the company will be limited to the amount of the order.

Filmobile S.A. cannot under any circumstances be held responsible for damage caused by a Customer to another Customer.

Article 8. Force majeure

Force majeure means any external, unpredictable and irresistible event, independent of the control of Filmobile S.A. and obstructing the performance of the services. The party wishing to invoke a case of force majeure must notify the other party of the beginning and end of this event as soon as it becomes aware of it.

Article 9. Intellectual property

The brands and logos used are the property of Filmobile S.A and Glimma Sàrl. and are protected by intellectual property rights. The Client is therefore in no way authorized to use them without the written consent of the company. Any unauthorized use would constitute a violation of the Company’s proprietary rights.

The Customer therefore refrains from any reproduction, use or exploitation of intellectual property rights belonging to Filmobile S.A and Glimma Sàrl.

Filmobile S.A. only grants the Client the right to participate in the Game, according to the conditions set out in this Contract.

In addition and taking into account the nature of the Games offered, the Client is required not to disclose the details and solutions of the puzzles which would violate the commercial interests of the company.

Article 10. Personal data

The customer agrees to receive information and promotional offers from Filmobile SA and Glimma Sàrl. At any time, you will be free to unsubscribe permanently.

The Customer is also informed that as part of the Game, Filmobile S.A. may use a video surveillance and listening device allowing it to follow the Game session, without recording.

Article 11. Advertisement

Photos or video sequences may be taken as part of the Game. The Client thus authorizes Filmobile S.A. free of charge to reproduce and/or distribute all or part of the Images on its Website as well as on its advertising media and this solely for purposes demonstrative. This authorization is granted without limitation of duration from acceptance of these general conditions of sale. However, the client can indicate to the staff on site his intention not to be published.
